24 CFR Part 58 is the Federal regulation that outlines the environmental review procedures for entities assuming HUD environmental responsibilities. Compliance under this regulation will fulfill the requirements of the National Environmental Policy Act (NEPA), additional Federal regulations required by the U.S. Department of Housing and Development (HUD), and a few state/local environmental requirements. In regard to projects undertaken by Los Angeles Housing Department (LAHD), the review done under 24 CFR Part 58 is often referred to as the NEPA review.

Historic Preservation Section 106 Review

All projects must adhere to Section 106 of the National Historic Preservation Act of 1966, also known as 36 CFR 800. During the environmental review, all projects are evaluated for their potential impact on properties designated as historic, eligible for historic status, or located within a historic district. This evaluation process is commonly referred to as the Section 106 Review.

Projects that may impact historic properties must be reviewed to guarantee that project plans will meet the Secretary of the Interior’s Standards for Rehabilitation and the California Historic Building Code. If necessary, LAHD will outline a set of conditions for the project proponent to follow, in addition to conducting a walkthrough at 50% and 100% completion to verify compliance.

These notices satisfy two separate but related procedural requirements for activities to be undertaken by the Los Angeles Housing Department (LAHD).

REQUEST FOR RELEASE OF FUNDS

On or about September 24th, Los Angeles Housing Department (LAHD) will submit a request to the U.S. Department of Housing and Urban Development (HUD), Office of Public and Indian Housing (PIH), for the release of funding under the Restore-Rebuild Rental Assistance Demonstration (RAD) program, authorized by the Consolidated and Further Continuing Appropriations Act, 2012 (Pub. L. 112-55, approved November 18, 2011) (2012 Appropriations Act) and later amended to undertake the following project:

PROJECT: New Clark Residence

PURPOSE: The New Clark Residence is an occupied rehabilitation project and proposed conversion from an SRO to an affordable housing project with studio apartments housing a non-targeted population. The property was originally constructed in 1913 as a YWCA. Abode Communities rehabilitated the building most recently in 1996. The building is a designated Los Angeles Historic-Cultural Monument and on the National Register of Places. New Clark Residence is located on a regularly shaped site, approximately 1.117 acres in size. The project is a single five-story building. The property currently consists of 152 units, with 150 single room occupancy (SRO) units, 1 two-bedroom manager’s unit and 1-one bedroom maintenance staff unit. The proposed project involves a planned conversion to 107 units with 106 studio units and 1 two-bedroom manager’s unit. There are currently 11 parking spaces and 1 accessible parking space, for a total of 12 parking spaces. This project’s housing type is non-targeted, but will add additional housing serving low-income existing and future population. The New Clark Residence housing project is a rehabilitation project of an existing 5-story building, with 107 studio apartments. There will be fifty-three (53) 0-bedroom Studio units using RAD Section 8 PBVs for 20 years. There will be one (1) 2-bedroom manager’s unit and 1-bedroom maintenance staff unit not using vouchers. The new 107-unit total rehabilitation of the existing historic building will provide tenants with their own bathrooms and kitchens to increase independence and quality of life.
Funding: HACLA is reserving funding in the total amount of $29,612,160 for fifty-three (53) 0-bedroom units at New Clark Residences. The RAD Section 8 funding is anticipated to be provided over 20 years through annual disbursements in the approximate amount of $1,480,608. Funding for the project is based on the HUD approved monthly Voucher Payment Standards (VPS) for 0-bedroom units at New Clark Residences ($2,328/unit).

FINDING OF NO SIGNIFICANT IMPACT

An Environmental Assessment under 24 CFR Part 58 was conducted for the above-mentioned projects. LAHD has determined that these projects will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available to the public for review during the comment period electronically (see link below). Purpose: The Housing Authority of the City of Los Angeles (HACLA) is proposing to purchase 3223 Sheffield Avenue (APN: 5220-001-910) and transfer the property to Housing Opportunities for Angelenos Inc (HOA) a HACLA instrumentality. The property contains an unhabitable two bedroom single-family home. HOA will renovate the home to be used to as housing for households with incomes not exceeding 50% of the average median income for Los Angeles-Long Beach-Glendale, CA HUD Metro Area. In addition to renovating the home HOA will renovate the existing garage on the property as an Accessory Dwelling Unit (“ADU”). The rehabilitation will include repair and/or replacement of exterior roofing, windows, paint, and lighting; repair and/or replacement of interior appliances, walls, casework, flooring, and fixtures; electric, water, and HVAC systems upgrades; pavement and landscaping repairs or replacement including installation of new irrigation systems; Safety Fire life upgrades, and ADA retrofitting. The scope also includes the addition of an ADU which is anticipated to be developed as a conversion of the existing garage. If feasible, Standard Plans that have been pre-approved by LADBS under the Standard Plan Program for compliance with building, residential, and green codes will be used for the ADU unit.

The Restore-Rebuild to RAD to PBV program in California provides a way for PHAs to recover lost public housing resources, construct new affordable homes, and use PBVs to support the financial feasibility and long-term affordability of these developments.

PUBLIC COMMENTS
Any individual, group, or agency may submit written comments to ERR to the Los Angeles Housing Department (LAHD). All comments received by July 22nd will be considered by the LAHD prior to submission of a request of funds.

ENVIRONMENTAL CERTIFICATION
LAHD certifies to HUD that Tiena Johnson Hall in her capacity as General Manager of the Los Angeles Housing Department consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows LAHD to use program funds.

OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to the Responsible Entity’s (RE) Request for Release of Funds and Environmental Certification for a period of fifteen days following the submission date specified above or the actual receipt of the request (whichever is later) only if they are on the following bases: (a) the certification was not executed by the Certifying Officer of the RE; (b) the RE has omitted a step or failed to make a determination or finding required by HUD regulations at 24 CFR part 58 or by CEQ regulations at 40 CFR 1500-1508, as applicable; (c) the RE has omitted one or more steps in the preparation, completion or publication of the Environmental Assessment or Environmental Impact Study per 24 CFR Subparts E, F or G of Part 58, as applicable; (d) the grant recipient or other participant in the development process has committed funds for or undertaken activities not authorized by 24 CFR Part 58 before release of funds and approval of the environmental certification; (e) another Federal, State or local agency has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD Los Angeles Office of Public Housing at 300 North Los Angeles Street, Suite 4054, Los Angeles, CA 90012, or email to HUDLOSANGELESOPH@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.

On or about July 23rd, Los Angeles Housing Department (LAHD) will submit a request to the U.S. Department of Housing and Urban Development (HUD), Office of Public and Indian Housing (PIH), for the release of funding under the Restore-Rebuild Rental Assistance Demonstration (RAD) program, authorized by the Consolidated and Further Continuing Appropriations Act, 2012 (Pub. L. 112-55, approved November 18, 2011) (2012 Appropriations Act) and later amended to undertake the following project:

Project #1: HACLA 5477 Keats Project
Location: 5477 E. Keats Street, Los Angeles, CA 90032
Purpose: This project involved the acquisition of a real property located at 5477 E. Keats Street (APN: 5292-021-900) by the Housing Authority of the City of Los Angles (HACLA). The project will involve rehabilitation of an existing 3-bedroom single-family residence built in 1937, with an addition of both an ADU and JADU. Work will include unit and site updates to comply with HUD and HACLA, as well as any ADA mobility and or communication requirements that are required. This project will be using RAD conversion to PBVs. Funding for the proposed project would be financed through three sources: The City of Los Angeles’ Unappropriated Balance Fund, U.S. Department of Housing and Urban Development (HUD) operating subsidy (Faircloth to RAD PBV). This project will provide supportive housing to individuals and households with incomes not exceeding 50% of the average media income (AMI).

Funding: $757,322 / Restore-Rebuild to PBV Program

The Restore-Rebuild to RAD to PBV program in California provides a way for PHAs to recover lost public housing resources, construct new affordable homes, and use PBVs to support the financial feasibility and long-term affordability of these developments.
The activities proposed are categorically excluded under HUD regulation 24 CFR part 58 from National Environmental Policy Act (NEPA) requirements or alternative.
